Wills
A will expresses an individual’s specific wishes regarding the distribution of assets after death. A will needs to name an Executor to manage the estate’s administration. When necessary, a will can name a guardian for minor children should parents pass away.
Who should have a Will?
Any adult in British Columbia can write a will, but people who have real estate, vehicles, businesses, or other assets have the greatest need for one. Power of Attorney
A power of attorney document takes effect when an individual loses the capacity to manage financial tasks and legal issues.
The document names one or more adults who will assume legal authority to complete financial and legal transactions should the grantor become physically or mentally incapable. Creating a power of attorney requires careful consideration of what activates it and who is granted the power of attorney.
When an adult suddenly becomes incapacitated and no power of attorney exists, a judicial process must determine who can assume an incapacitated person’s authority over financial and legal matters. A power of attorney may also designate funds for paying an attorney to perform administrative duties.
